By accessing or using LinkGate (the “Service”), available at linkgate.gg, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.
Your continued use of LinkGate after any changes to these Terms means you accept those changes. We will make reasonable efforts to notify you of material updates, but it is your responsibility to review these Terms periodically.
Important: These Terms form a legally binding agreement between you (“User”, “you”) and the operator of LinkGate (“we”, “us”, “our”). Please read them carefully before using the Service.
2. Eligibility
You must be at least 13 years old to create an account or use LinkGate. If you are between 13 and 18 (or the age of majority in your jurisdiction), you may only use the Service with the consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf.
By using LinkGate you represent that you meet the eligibility requirements above. We reserve the right to terminate accounts where we reasonably believe the user does not meet these requirements.

4. Use License & Restrictions
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for lawful personal or commercial purposes, subject to these Terms.

You are solely responsible for all content you create, upload, or share through LinkGate — including link titles, descriptions, thumbnails, and the destination URLs you connect to.
You retain all rights to your content. By using LinkGate you grant us a worldwide, royalty-free licence to host, display, cache, and transmit your content solely to operate and improve the Service.
You must ensure your content complies with all applicable laws, including intellectual property, privacy, and advertising regulations.
We may (but are not obligated to) review content and remove or disable anything that violates these Terms, without prior notice.
We do not pre-screen user content and are not liable for any content posted by users of the Service.
7. Intellectual Property
The Service and all related technology, branding, design, and documentation are owned by LinkGate and are protected by applicable intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Service beyond the limited licence in Section 4.
8. Third-Party Platforms & Links
LinkGate allows you to create gated links that involve actions on third-party platforms (YouTube, TikTok, Instagram, Twitter/X, Discord, etc.). You acknowledge that:
LinkGate is not affiliated with, endorsed by, or sponsored by any third-party platform. All third-party trademarks belong to their respective owners.
Your use of third-party platforms is governed by their own terms and policies. You are responsible for complying with them.
We are not responsible for the availability, accuracy, or content of any third-party platforms or external websites linked through the Service. You access them at your own risk.
9. Service Availability & Modifications
We strive to keep LinkGate available and reliable but make no guarantees of uninterrupted or error-free access.
We may modify, suspend, or discontinue any feature of the Service at any time, with or without notice, for any reason including maintenance, security, or business decisions.
No liability: We are not liable for any loss, damage, or inconvenience caused by temporary or permanent unavailability of the Service or any of its features.
10. Termination & Suspension
We may suspend or terminate your account at our sole discretion, without prior notice, if we believe you have violated these Terms or are engaging in conduct that is harmful to the Service, other users, or third parties.
Grounds for termination include

Your rights: You may delete your account at any time through your dashboard settings. Upon termination (whether by you or us), your right to use the Service ceases immediately. We may delete your data in accordance with our Privacy Policy.

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, secure, or free of errors, viruses, or other harmful components. You use the Service at your own risk. No advice or information obtained from us creates any warranty not expressly stated in these Terms.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LINKGATE AND ITS OPERATORS, AFFILIATES, AND CONTRIBUTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL — ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.
Our total aggregate liability to you for all claims arising from or related to the Service shall not exceed the greater of (a) the amount you paid us, if any, in the twelve (12) months before the event giving rise to the claim, or (b) fifty US dollars (US $50).
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the greatest extent permitted by law.

We will review valid notices and, where appropriate, remove or disable access to the content. Repeat infringers may have their accounts terminated.
15. Dispute Resolution & Governing Law
Informal resolution first: Before filing any formal legal action, you agree to contact us at contact.linkgate@gmail.com and attempt to resolve the dispute informally for at least 30 days.
Arbitration: If the dispute is not resolved informally, you and LinkGate agree to resolve it through final and binding individual arbitration, except that either party may bring qualifying claims in small claims court. You waive any right to participate in a class action or class-wide arbitration.
Governing law: These Terms are governed by the laws of the jurisdiction in which LinkGate's operator resides, without regard to conflict-of-law principles. Any proceedings shall be conducted in English.

We may revise these Terms at any time. Material changes will be communicated by email or by a prominent notice on the Service at least 14 days before they take effect. Your continued use of LinkGate after the effective date constitutes acceptance of the revised Terms.
